INTRODUCTION

Kumar is a Solicitor (England & Wales), Accredited mediator in the United Kingdom and an Advocate in India. He founded the firm in the year 2011 and is currently the Managing Director/Partner in the firm. His areas of expertise are commercial and residential property, corporate and personal immigration, corporate law, commercial and civil litigation.

Kumar’s legal practice encompasses all aspects of both commercial and residential property law, including acting on sales and purchases, secured lending work, the preparation of development agreements and landlord and tenant matters. He deals with a broad range of clients, including private individuals and companies of different sizes who operate in a range of sectors.

Kumar has particular experience of acting for clients in Hospitality, Care Homes, Dental and GP practices and in a range of commercial property matters. Kumar recently assisted in the acquisition of a £4 million care home property and the business therein for a high profile client in the west end. He also acted in the acquisition of a freehold and disposal of a leasehold property for a busy GP practice with a total value of £2.2 million.

Kumar regularly acts for a high net worth landlord in relation to his property affairs and advises him in relation to his investments both in the UK and Abroad and have assisted him in dealing with secured lending and concluding the security requirements of lenders in connection with his £3 million freehold residential property; He also had acted for the same client in an application to the local authority to convert an old pub in to a 10 two bed high value flats in Kingston-Upon-Thames and is currently dealing with the disposal of each of these individual flats.

Kumar has acted in the acquisition of a commercial freehold property for £1.2 million which also involves franchises from WHSmith, Post Office & a reputable retail business.

 

Kumar has experience and expertise in all types of civil and commercial claims, using his business acumen to advise you as to the best solution for you and your business. He is a qualified and Accredited Mediator and places a heavy emphasis on Alternative Dispute Resolution to seek to resolve your dispute as early as possible in order to avoid the potential complexity and cost of such claims for his clients. He advises client on disputes in all areas of commerce and business which included disputes concerning commercial contracts between businesses, disputes concerning partners, directors, or shareholders in a business; issues regarding intellectual property rights or information technology, including claims involving copyright and passing off, commercial landlord and tenant matters, disputes involving shipping contracts etc.

Kumar heads the firm’s corporate immigration team. He advises multinational corporate clients and the board of various universities and large private sector clients on risk management, sponsor compliance matters and the immigration aspects of business restructuring. Kumar often liaises with senior Home Office officials on behalf of clients to discuss and resolve issues faced by clients in relation to their immigration needs.

He also has in depth experience in challenging Home Office decisions to suspend/revoke sponsor licences under both Tier 2 and Tier 4 categories and has a proven success record in obtaininig interim orders to reinstate the sponsor licence and also winning the judicial review claims at the High Court. He had acted for a reputed Information Technology company which had employed 65 employees including 15 skilled migrants in various IT positions, when its licence was revoked and all the migrants were asked to find another sponsor or to return to their home country. Kumar successfully challenged the decision at the High Court and got an interim injunction against the revocation and finally the licence was reinstated in full when the home office by consent agreed to withdraw the decision.

His specialist areas of work also include immigration services for private individuals, many of whom are applying for Tier 1 investor and entrepreneur visas, and he has a wealth of experience in dealing with human rights cases, appeals, judicial reviews and Court of Appeal matters. His clients are spread across the firm’s education, charities, retail, sports and entertainment and technology sectors. His clients also include companies and individuals based in India, Middle East, China, USA, Mauritius, South Africa, Turkey, Singapore, Taiwan and Europe and regularly advises clients on Indian Immigration Law.

Kumar advises clients both from United Kingdom and abroad (especially India) on a wide range of corporate and commercial matters including company formation, business sales, mergers and acquisitions, corporate restructures and commercial contracts.

He has assisted companies with asset sales and purchases, including transfer of undertakings, business mergers, corporate finance and share purchases and sales. He has expertise to deal with business and commercial agreements – from company formations to joint ventures and limited liability partnerships, and from shareholder agreements to share options. In addition, he had acted for clients in actively defending their intellectual property issues, from copyright and patents to internet domain protection.

Kumar is a qualified Advocate in India and has been practising in that jurisdiction since year 1997. He has extensive experience in dealing with various areas of law and had represented owners, developers, lenders, government bodies, bondholders, borrowers, high net worth landlords and tenants in relation to their property and corporate matters. He regularly advises clients both in the United Kingdom and India in the purchase or sale contracts including acquisition of commercial assests, specific performance and other fraud/mistake claims, mortgage on secured loans including foreclosure, receivership, guaranty enforcement and disbursement issues, as well as lender liability. He has experience in Public financing of public-private partnerships relating to, infrastructure, and other government supported projects and involving foreign investments.

Kumar’s multidisciplinary approach and his broad experience translates into efficient and highly effective handling of clients and their issues and cross border disputes. He closely works with reputed law firms in India where he would seek assistance and work together on instructions which he is not able to handle on his own with his expertise.

He is an Accredited Mediator from London School of Mediation and is authorised to conduct mediation in the United Kingdom and Abroad.

Kumar has a Masters Degree in Law (International Trade Law) from Newcastle University and also holds Bachelor Degrees in Law and Science.

He is a family man married with two young children and keeps fit by regularly practising hatha yoga and playing badminton. He played competitive cricket in his student days and during his spare time provides cricket coaching to his son
